Terms and Conditions of Sale for the Online Store Operated by STRONGFLEX.PL SP. Z O.O. Based in Wrocław

§1 Preliminary Provisions

  1. These terms and conditions define the rules for using the website www.strongflex.eu (hereinafter: the "Website").
  2. The Terms and Conditions are available to every person visiting the Website and apply to all users of the Website, regardless of the nature of their activity.
  3. The Website is owned and managed by STRONGFLEX.PL SP. Z O.O. with its registered office at:

    (hereinafter: the "Administrator" or the "Seller").
  4. Using the Website is tantamount to accepting the Terms and Conditions and the Privacy Policy, which is an integral part of the Terms and Conditions. Acceptance of the Terms and Conditions and the Privacy Policy is required before using the service.
  5. The Privacy Policy can be found on the store's website in the Privacy Policy section.

§2 Definitions

  1. Terms and Conditions – this document defining the rules for using the website www.strongflex.eu.
  2. Store – the online platform operated at www.strongflex.eu.
  3. Customer – a natural or legal person who has used the services of the online store, including consumers.
  4. Product – polyurethane bushings and other items made available for sale through the online Store.
  5. Order – the Customer's declaration of intent directed to the Store, aimed directly at concluding a sales contract for the Product.
  6. Sales Agreement – the sales contract concluded between the Customer and the Seller concerning the Product, concluded based on Polish law.

§3 Offer

  1. The offer of the online Store www.strongflex.eu includes the sale of polyurethane bushings designed for passenger cars and vans.
  2. All products offered in the store are brand new and covered by the manufacturer's warranty.
  3. Product prices include VAT but do not include delivery costs. Prices can be displayed without VAT upon prior arrangement via electronic, telecommunication means, or verbal agreement, applicable only to business customers.
  4. The store's offer is up-to-date and complies with available products.
  5. The Store reserves the right to change product prices and the offer without prior notice. Price changes do not affect orders already placed.
  6. The Store is committed to providing up-to-date and truthful information about the products offered, including their features and properties.
  7. For non-standard attributes – i.e., those defined by the customer in a text field (e.g., selecting the "Custom" option when specifying product diameter), the product is treated as a custom-made product and is not subject to return.
  8. If the product color is changed to a non-standard one (other than the standard versions: yellow and red) or other modifications are agreed upon between the parties, the product is considered custom-made and is not subject to return.

§4 Placing and Fulfilling Orders

  1. Orders for products offered on the website can be placed 24 hours a day, year-round, via the order form available on the website.
  2. After placing an order, the Customer will receive a confirmation of the order to the email address provided.
  3. Order processing begins after the Seller receives payment to the bank account specified on the website.
  4. The order processing time is 1-5 business days from the moment the payment is confirmed.
  5. Products are shipped to the address provided by the Customer or to a collection point.
  6. Delivery costs are provided before placing the order.
  7. The delivery time depends on the delivery method chosen by the customer and the location. This information is visible on the order page in the "Delivery" section.
  8. In the event of product unavailability, the Seller undertakes to promptly notify the Customer and agree on further proceedings.
  9. If delivery issues arise, the Customer should contact the Store and inform them about the undelivered package. Such cases are reviewed individually. Once the goods are shipped, responsibility is transferred to the carrier.
  10. The Seller reserves the right to withdraw from the contract in the event of force majeure.
  11. Choosing additional stickers does not guarantee their inclusion with the order.

§5 Prices and Payments

  1. All product prices listed on the website www.strongflex.eu are gross prices and include VAT. Prices can be displayed without VAT upon prior arrangement via electronic, telecommunication means, or verbal agreement, applicable only to business customers.
  2. Available payment methods:

    • Cash on delivery

  4. For bank transfers, the customer must make the payment within 5 business days of placing the order. Failure to do so will result in order cancellation.
  5. For card payments, payments are made via an online payment system, following the security procedures employed by the payment service provider.
  6. The Administrator reserves the right to change product prices listed in the offer. Price changes do not affect products already ordered by the customer.

§6 Delivery and Transport

  1. Delivery of goods ordered on the website www.strongflex.eu is at the cost and risk of the customer. For consumers, the risk transfers to the consumer only upon receipt of the goods.
  2. The delivery time and method will be agreed upon between the parties after placing the order.
  3. If the product cannot be delivered within the chosen time, the Seller undertakes to promptly notify the Customer about the order status.
  4. If the product cannot be delivered within the chosen time, the Customer has the right to withdraw from the contract without additional costs. Refunds will be issued within 14 days of withdrawal from the contract.
  5. Product transport is conducted under the conditions specified in the agreement between the parties or according to the carrier's offer.
  6. Orders placed after 12:00 PM Polish time (GMT +01:00) will be treated as orders placed the next business day.

§7 Complaints and Returns

  1. The Customer has the right to file a complaint about products purchased on the Website.
  2. Complaints must be submitted within 14 days of receiving the product.
  3. A complaint should include a description of the defect, the order date and number, and the Customer's contact details. Consumers are not required to provide a detailed defect description, a notification of the defect suffices.
  4. If the complaint is accepted by the Seller, the Customer can choose to exchange the product for another or receive a refund. The Customer has the right to choose how the complaint is resolved (repair, replacement, price reduction, or withdrawal from the contract).
  5. If the complaint is rejected by the Seller, the product will be returned to the Customer. The Seller must justify the rejection and indicate further steps (e.g., mediation).
  6. Product returns will only be accepted if the product is undamaged, clean, and its packaging is intact.
  7. The Seller is not responsible for damages caused during the transport of products to the Customer.
  8. Return shipping costs for complaints and returns are borne by the Customer.
  9. Detailed conditions for complaints and returns are outlined in the Returns and Complaints Policy, available on the Website in the Shipping and Returns section.
  10. Consumers have the right to file a complaint about discrepancies between the product and its description on the website www.strongflex.eu within 14 days of receiving the product.
  11. If discrepancies are found, the Seller undertakes to promptly resolve them or refund the payment to the Consumer.
  12. To file a complaint, the Consumer should contact the Seller by sending an email to: info@strongflex.eu.

§8 Liability and Warranty

  1. The Seller is liable for discrepancies between the product and the contract under the provisions of the Civil Code, particularly regarding warranty regulations.
  2. The Seller guarantees that the product is free from defects and will meet the specified properties.
  3. The warranty is granted for the period specified in the product description or another separate document. If no such information is provided, the warranty period is two years for SPORT-type products and lifetime for standard products (the lifetime warranty does not apply to products used in motorsports).
  4. If a defect is found, the Customer may submit a complaint within the period specified in the Consumer Sale Act or the product description. If no such information is available, complaints must be filed within two months of discovering the defect.
  5. If the complaint is accepted, the Seller is obligated to remove the defect within the time specified in the Consumer Sale Act or the product description. If no such information is available, the defect must be remedied within 14 days.
  6. If the defect cannot be remedied or is not remedied within the specified time, the Customer may demand a price reduction or withdraw from the contract.
  7. If the Customer withdraws from the contract, the Seller is obligated to refund the full price of the product within 14 days of receiving the returned product in its original condition.
  8. If the product is custom-made according to the Customer's specifications, it is considered a "custom order" and is not subject to return.

§9 Final Provisions

  1. The Administrator reserves the right to amend the Terms and Conditions. Amendments do not apply to orders placed before the amendment date.
  2. All rights and obligations arising from the sales agreement cannot be transferred to third parties.
  3. The sales agreement is concluded under Polish law. In case of a dispute, the Customer may use alternative dispute resolution methods, such as mediation. If the dispute cannot be resolved amicably, it will be settled by the court competent for the registered office of STRONGFLEX.PL SP. Z O.O.
